OREM — Orem police say Circuit City is not liable for the death of 5-year-old Alexandra Stilson, who was crushed Wednesday when a 100-pound television fell on top of her.

"We have concluded our investigation and have determined that this was a very tragic accident, with no criminal liability on the part of anyone," said Orem Police Lt. Doug Edwards.

Stilson — who was called Alex by friends and family — is the daughter of Scott and Jerri Stilson. Alex Stilson was the oldest of the Payson family's two children.

Alex Stilson suffered massive head injuries in the 4 p.m. accident. She was airlifted to a Salt Lake Hospital for emergency care but was pronounced dead shortly after arrival.

Law enforcement officials would have been required to prove the company was criminally negligent by placing the television on a display stand that had proven to be dangerous, Edwards said.

Police and prosecutors also have to show "evidence that a corporation was aware of a risk beforehand and then allowed or encouraged it to continue," Edwards said.

Alan McCullough, Circuit City's top executive, traveled to Utah Thursday to offer support to the grieving family and store employees. McCullough said the TV was on a type of display stand that is used in all of the company's stores.

It was Circuit City's first such accident in 50 years.
