Federal misdemeanor charges have been filed against two Davis County men accused of cutting an illegal road across U.S. Forest Service land on the Bountiful bench for a snowmobile and ATV recreational area.

Kenneth C. Patey, Bountiful, and Nick Doyle, Syracuse, are charged with illegally constructing a road in the Wasatch-Cache National Forest near Mueller Park in east Bountiful to have access to property owned by Patey, according to a complaint filed in U.S. District Court.

The complaint states Patey bought property adjacent to Forest Service land and asked the Forest Service for permission to make improvements on the Kenny Creek Trail, part of the Forest Service land, to give him access to his property. Forest Service employees told Patey he could not disturb the ground without authorization. The complaint said Patey twice in 2001 told the Forest Service he wanted to build a road across Forest Service land, and both times he was told he couldn't without authorization.

Subsequent construction of a trail occurred without authorization in November 2001, according to the complaint. Doyle told Forest Service investigators he rented a bulldozer from his employer and began work on the trail at the direction of Patey.

Bountiful city filed a property damage suit against Patey in May 2001. The case is pending.
