A photographer accused of trying to extort $3.3 million from Cameron Diaz for pictures taken before she became famous must stay jailed or pay a high bail amount.

Superior Court Judge Ann Jones on Wednesday said John Rutter of Los Angeles must remain jailed in place of $250,000 bail.

In a related matter, Diaz has sued Rutter in civil court to keep the photographs from being published. That case begins Friday in Santa Monica Superior Court before Judge Alan B. Haber.

The photographs taken around 1992 are being held in a safe deposit box. Diaz's lawyers have declined to describe the photos and are asking for an injunction to keep them from being made public.
