PROVO — A Bountiful woman testified Tuesday that when an acquaintance picked her up at her grandparents' Holladay home the night of Feb. 3, all she wanted was a cigarette.

Instead, the 30-year-old woman said, she woke up to find the man raping her in his pickup truck in the middle of nowhere.

Fourth District Judge Fred Howard ordered Jake Machan, 25, of Kearns, to stand trial on first-degree felony charges of rape, object rape and aggravated kidnapping.

The woman testified that she was staying with her grandparents in preparation for an early-morning doctor's appointment and repeatedly told Machan to take her back. But, apparently from the effects of cold medicine and a "big swig" of vodka she took from a bottle in his truck, the woman passed out after a short trip to a nearby 7-Eleven.

"The next thing I remember is being in the front passenger seat of the truck with him having sex with me," she said. "All I knew was it was pitch black and there was just dirt for miles (around)."

She said Machan continued to rape her despite her pleas for him to stop. According to the woman, as they were driving away — and while Machan allegedly smoked methamphetamine and groped her — she called 911 under the guise of calling her sister and got Machan to say which mile they were at on state Route 68 south of Saratoga Springs.

A dispatcher culled enough information from the call to guide officers to Machan's vehicle and arrest him shortly after midnight.

According to testimony from a Utah County sheriff's deputy, Machan said in an interview that he and the woman intended to go four-wheeling on the west side of Utah Lake. On the way, she fell asleep multiple times and at one point asked if she could take off all her clothes, which she did, Machan told investigators.

A detective testified that Machan admitted having sex with the woman but refused to answer further questions.

Asked by defense attorney Ron Yengich why she told officers at the scene she was "sorry," the woman said she felt "guilty."

"I was sorry I was out there and had caused all that ruckus," she said.

The detective testified that the woman appeared "surprisingly jovial" when interviewed at first, but later broke down when asked for specifics about what happened.

The woman said she met Machan at a Cottonwood Heights bar in early January and he spent time with her on three occasions, including ice skating, drinking at a bar and bringing her pizza during a hospital stay.

She said she was generally a "flirt" but never came on to Machan, believing he was married or had a girlfriend. She said he seemed "odd" and "secretive" and that she did not even know his last name.

But Machan told an investigator he thought she was his girlfriend, according to testimony.

Under questioning from Yengich, the woman said she was drinking heavily every day at the time, but did not on the day of the incident because of the upcoming doctor's appointment.

Prosecutor Chad Grunander said that the woman could not legally consent to sex if she was unconscious. He said she asked Machan to stop as soon as she woke up.

"When someone says no, that's where it ends. And we don't believe it ended there," Grunander said.

An arraignment is set for June 8.
