LANCASTER, Calif. — The backyard builder who created a quirky roadside attraction called Phonehenge West in the Southern California desert is tearing it down — and that means he might avoid jail.

Kim Fahey (FAY'-hee) was convicted of a dozen building code violations last year. He could have been sentenced to a year in jail on each count Friday.

But a judge delayed the hearing until next month after learning that Fahey on Friday planned to begin destroying a 70-foot-tall centerpiece tower.

Judge Daviann L. Mitchell praised Fahey and says she'll probably sentence him to community service instead of jail if he continues to demolish the 12 structures on his Acton property.

Fahey built the complex over 30 years, mainly using scrap. He and eight others were living there when authorities cracked down.
