A recreation group has filed a lawsuit claiming that Ogden city has balked in fulfilling its promise to build a new baseball-softball complex following the 1985 demolition of John Affleck Park.
The Northern Utah Recreation Association, headed by baseball entrepreneur Dar Belnap, filed the suit in 2nd District Court last week. No hearing date has been set.It seeks an accounting of all money spent on improving Miles Goodyear Park, which replaced the John Affleck baseball stadium, as well as more improvements to the facilities there.
The complaint is Belnap's second on the issue. In 1985 he sought to halt the demolition of the old baseball park but dropped the suit after the city agreed to build a new sports complex similar to the Ken Price park in Murray and have it completed by 1987.
The suit seeks to have the city spend $70,000 for the development and improvement of Miles Goodyear Park, including two baseball diamonds, fences, backstops, repairs and utilities.
City Community Services Director Ken Miller said Ogden has spent $450,000 in developing the baseball and softball diamonds at Miles Goodyear Park.
"We have a viable, working ball park complex," Miller said.
Belnap has complained about the lack of shower and dugout facilities at the new park, but Miller said improvements would be made as money becomes available.
