WHITEN WON'T BE CHARGED: Former New York Yankees outfielder Mark Whiten will not be charged with sexually assaulting a woman at a Milwaukee hotel last month because prosecutors don't have enough evidence against him.

BENNETT PLEADS GUILTY: Atlanta Falcons linebacker Cornelius Bennett pleaded guilty to sexual misconduct and could face up to a year in jail. Bennett, formerly with the Buffalo Bills, will be sentenced Oct. 28.

APPEAL REFUSED: The NCAA refused University of Miami wide receiver Jammi German's appeal to play his senior season. The decision was announced after an hour-long conference call between uni-ver-si-ty officials and the NCAA Student Athlete Eligibility Committee.

German, one of the Hurricanes' most explosive offensive threats, was declared ineligible last week because he initially lied about a limousine ride he took in Nov. 30, 1995, that was paid for by a sports agent.

MYERS WON'T PLAY: Michael Myers will definitely not play in No. 15 Alabama's game against Vanderbilt, the school's compliance director said. The school indefinitely suspended Myers, an All-Southeastern Conference defensive lineman in 1996, last week after receiving tips from the NCAA and SEC of possible off-season dealings with an agent.

Hockey

DAMPHOUSE A NO-SHOW: Montreal Canadiens team captain Vincent Damphousse, a restricted free agent who has been without a contract since July 1, was the only no-show among the 65 players invited on the first day of training camp. The center said his demands and the club's offer were "far apart" and he didn't want to risk injury by reporting.

DEVILS SIGN MORRISON: The New Jersey Devils signed Michigan center Brendan Morrison, the nation's best college hockey player last season, to a multiyear contract.

Morrison won the Hobey Baker Award as the nation's top collegiate player in 1996-97, when he had 31 goals and 57 assists in 43 games. He also was selected the most valuable player of the Central Collegiate Hockey Association tournament and was player of the year the past two seasons.

Basketball

ABL, FOX REACH DEAL: The American Basketball League and the FOX Sports Net announced an agreement to telecast 16 regular-season games on Sundays at 7 p.m. ET and up to seven playoff games, including all of the best-of-5 ABL championship series. The women's league - a rival to the WNBA that recently closed out its inaugural season - begins its second season Oct. 12.

FRESNO STATE-BOUND: Former Virginia basketball player Courtney Alexander, convicted of assaulting his girlfriend and sentenced to four days in jail last month, announced he is transferring to Fresno State.

Virginia coach Jeff Jones suspended Alexander indefinitely after his arrest on July 18, and about a month later Alexander said he was leaving the school. Alexander will have to sit out this season but will be eligible to play for the Bulldogs and coach Jerry Tarkanian in the 1998-99 season. He will have two years' eligibility remaining.

Tennis

SAMSUNG OPEN: At Bournemouth, England, top-seeded Carlos Moya and No. 2 Felix Mantilla advanced to the second round of the Samsung Open clay-court tournament, while No. 4 Cedric Pioline, No. 5 Marc-Kevin Goell-ner, No. 6 Filip DeWulf and No. 8 Christian Ruud were eliminated.

PRESIDENT'S CUP: At Tashkent, Uzbekistan, top-seeded Yevgeny Kafelnikov and No. 2 Tim Henman won their opening matches in the inaugural President's Cup tournament.

MARBELLA OPEN: At Marbella, Spain, the top three seeds - No. 1 Albert Costa, No. 2 Sergei Bera-sa-tegui and No. 3 Albert Portas - all won their first-round matches over fellow Spaniards in the $328,000 Marbella Open.

Auto racing

FITTIPALDI SURGERY: Racing champion Emerson Fittipaldi, who fractured his lower back when his small plane crashed in a swamp Sunday night, will have surgery in Miami.

The 50-year-old driver was to travel Tuesday night on a commercial flight and head to Miami's Jackson Memorial Hospital, his agent, Kika Concheso, said from Fittipaldi's office in Miami.

Soccer

JUDGE HALTS BAN: A federal judge ordered the Argentine Football Association not to ban Diego Maradona from playing while charges of drug use by the soccer superstar are being investigated. Maradona could play with his team, the Boca Juniors, against Newell's on Sunday.

HALL OF FAME CANDIDATES: Evelyn Ashford, winner of four Olympic gold medals and the former world record-holder at 100 meters, and Renaldo Nehemiah, the first man to break 13 seconds in the 110 hurdles, are among 11 candidates for election to the National Track and Field Hall of Fame.

Ashford and Nehamiah were on the ballot for the first time.

So were Arnie Robinson, the 1976 Olympic long jump gold medalist; Jack Davis, two-time Olympic silver medalist in the 110 hurdles; Craig Dixon, an Olympic bronze medalist in the hurdles who once won 59 straight races; Maren Seidler, a four-time Olympian in the shot put, and Dr. Evie Dennis, a longtime contributor to the sport.

The other candidates were 1964 Olympic 200-meter champion Henry Carr, three-time Olympic race walker Henry Laskau, former Abilene Christian coach Oliver Jackson, and the late Lucile Godbold, who set seven world and six American records, mainly in the shot put.
