SCREENING OF MOVIE TAKES DRAMATIC TURN WITH SHOOTING

SEATTLE (AP) -- A man has been charged with assault for allegedly shooting a fellow moviegoer who complained about his loud, sarcastic commentary during a screening of "Analyze This."Craig Kubeck and girlfriend Karen McLean sat in front of Kelvin and Christina Kirkpatrick on Saturday, prosecutors said in court documents.

Kubeck, 34, began loudly criticizing McLean and the movie about a mob boss who needs counseling. After several others asked him to be quiet, Kelvin Kirkpatrick sought out the theater manager.

A scuffle broke out, and Kubeck allegedly pulled out a .38-caliber handgun, shot Kirkpatrick in the stomach and then raised the gun to Kirkpatrick's head, court documents said.

According to court papers, Kubeck used a racial slur and yelled: "I'm going to kill you." Kirkpatrick, a former Marine who is black, jammed his thumb under the hammer of the gun to keep it from firing.

Kirkpatrick was released Monday from Harborview Medical Center.

FAMILY OF DEAD PATIENT SAYS HOSPITAL OWES EXPLANATION

WATSONVILLE, Calif. (AP) -- The family of a man hospitalized for surgery who died just outside the hospital after walking out is demanding to know how he could have left unnoticed.

"My wife called Monday night to see how dinner was, and he said it was great. Then we get a call at 3:45 a.m., saying he was found outside," said the man's son, Robert Ryan. "Why was he outside?"

The body of Robert Ryan, 67, of Watsonville was found on the sidewalk in his hospital gown, just outside the main entrance to the Watsonville Community Hospital early Tuesday.

He died of peritonitis -- an inflammation of a membrane lining the abdomen -- and a blood infection due to recent colon cancer surgery. The cold weather also contributed to Ryan's death, sheriff's detective Alan Burt said.

MOM WHO ALLOWED STRIPPER AT TEEN PARTY GETS PROBATION

PLEASANTON, Calif. (AP) -- A woman who allowed a male stripper to perform at her 15-year-old daughter's Halloween party has been sentenced to three years of probation.

Carye McGrath, 39, also was ordered Thursday to apologize in writing to the parents of other partygoers, undergo psychological counseling, perform 240 hours of community service and pay a $350 fine.

McGrath's daughter hired the stripper, but it was the mother's responsibility to stop the party, Judge Christine Moruzo said.

RAWLINS POLICE TACKLE MAN HOLDING HIS SONS HOSTAGE

RAWLINS, Wyo. (AP) -- Authorities smashed through a sliding glass door and tackled the father of four children he had held hostage for four days.

Eric DeMillard, 42, who was armed with a pistol, was tackled as he ran down a hallway Thursday night. Authorities wrestled the gun away and no shots were fired, police Chief Tony Rose said.

Two of the DeMillard's sons, 9 and 6, were being examined at a local hospital.

3 INMATES STILL ON THE RUN AFTER BREAKOUT IN OKLAHOMA

LAWTON, Okla. (AP) -- An inmate used a long barbecue fork to threaten a guard and freed eight other prisoners in a breakout at the Comanche County Jail. Five were captured within hours.

The inmates still on the run today included a man awaiting trial on murder charges. A convicted murderer and another man facing murder charges were among those captured.

No one was injured in Thursday's escape. An officer was locked in a storage area where she had gone to get supplies for inmate breakfasts.

MISSOURI POLICE IMPOUND A PECK OF POT-FILLED PEPPERS

STRAFFORD, Mo. (AP) -- A truck that pulled into a highway weighing station tipped the scales with more than 7,000 pounds of marijuana packed in hot peppers, the biggest drug haul ever in Missouri.

The driver, whose name was not released, was arrested for investigation of interstate transportation of narcotics.

He had 81 cases of marijuana valued at about $7.5 million, along with several hundred cases of hot peppers, authorities said Thursday.

EX-MOUSEKETEER SENTENCED TO 2 YEARS IN FEDERAL PRISON

LOS ANGELES (AP) -- A former Mouseketeer has been sentenced to two years in federal prison for using phony or bounced checks to buy investments and lying about it to the Securities and Exchange Commission.

Darlene Fraschilla, who changed her last name from Gillespie after her January marriage, showed no emotion at Thursday's sentencing. She also must pay $6,144 in restitution and serve three years of supervised release.

She must report to prison by July 26. Fraschilla, who was one of the nine original Mouseketeers on the Mickey Mouse Club television show from 1955-1959, had faced up to 90 years in prison.
