NAMPA, Idaho — Nampa library officials, responding to the threat of a lawsuit, say two sex education books will be returned to their regular spot on book shelves.

In June, the Nampa Public Library Board voted to permanently remove "The New Joy of Sex" and "The Joy of Gay Sex" from the shelves. The board ordered the books be stored instead in the director's office, making them available only upon request.

But last week, the American Civil Liberties Union of Idaho threatened to sue the library, claiming the decision violated the First Amendment.

During a meeting last Friday, the board did just that, characterizing its policy change as a matter of fiscal responsibility. Nampa City Attorney Terry White told the board it could cost hundreds of thousands of dollars to fight a free speech case.
