SALT LAKE CITY — Two adults who were having sex when the woman’s young daughter walked in on them now face criminal charges after court documents allege that the couple did not stop.

A Cottonwood Heights woman, 35, and a Midvale man, 56, were each charged Friday in 3rd District Court with dealing in harmful materials to a minor, a third-degree felony, and lewdness involving a child, a class A misdemeanor.

In June 2018, the couple was engaged in sexual intercourse in a living room in front of the woman’s 3-year-old daughter, according to charging documents.

“When (the child) reached up and patted (the man) on the head, (he) expressed concern, but (the woman) stated that it was OK and (he) should keep going,” the charges state.

When asked how investigators learned about this, Salt Lake County District Attorney Sim Gill said that the charges are based on the totality of the evidence, which includes additional information that may be revealed in court that points to the couple intentionally engaging in the conduct.
