Prosecutors have decided to drop a murder charge against Aaron Galli, even though a jury once convicted him of that charge.
If the state had gone to trial as scheduled Tuesday, those involved in the case say it is unlikely a jury again would convict Galli of murder. Realizing this, prosecutors will drop the charge but could refile it should they come up with additional evidence.Galli, 23, was convicted of killing Merritt Riordan at the Green Parrot Cafe on May 17, 1992. Prosecutors believe his brother, Adam Galli, fired the fatal shot but believe Aaron was with him and fought with the victim.
Christopher Galli testified that he drove his cousins to the Green Parrot that evening and said they later told him the details of the shooting.
But after the trial, Christopher basically told people he had lied. A judge ordered a new trial for Aaron.
Aaron Galli is serving a one- to 15-year prison sentence for an unrelated robbery.
