No criminal charges will be filed against an Ogden man who police initially said kidnapped his girlfriend at gunpoint and held her hostage.

Deputy Weber County Attorney Kristine Knowlton said there is insufficient evidence to substantiate the accusations against Randell Troy Montoya, 23.More than a dozen Ogden and Weber County law enforcement officials spent hours Dec. 2 outside a West Haven home where they said Montoya took his girlfriend.

Police had received a report that Montoya assaulted the woman, was armed with a gun and took her to the home by force. They said they were unable to communicate with him via telephone and bullhorn.

Montoya called the incident a mistake blown out of proportion by police.
