Police have released the suspect arrested in connection with the shooting death of a Uintah County man this week because they believe the shooting was in self-defense.

Roosevelt Police Chief Cecil Gurr said no charges will be filed against Jeff Butler, 34, Roosevelt, in the death of Kevin Bromley, 20, Lapoint. He said Bromley was shot four times with a .38 revolver during an altercation at Butler's south Roosevelt home. Bromley's ex-wife, Dawn Gardner, 29, of Uintah County, was also present during the shooting.Law enforcement authorities took Butler into custody shortly after the 8:30 p.m. shooting, arresting him on "suspicion of criminal homicide."

"At this time, investigation and analysis of evidence gathered is continuing," said Gurr. "The final report of the medical examiner will not be available for a week. However, based upon evidence available at this time, a preliminary determination has been made that it appears Mr. Butler acted in self-defense and in defense of Ms. Gardner.

"There is evidence of an ongoing struggle at the scene. Mr. Butler and Ms. Gardner had injuries. They were taken to the Duchesne County Hospital for treatment."

Gurr declined to elaborate on their injuries and would not say what type of weapon Bromley had in his possession.

Law enforcement had responded to the Butler residence earlier that evening, Gurr said. "There was a report of concern for the safety of Ms. Gardner in light of the conduct of Mr. Bromley. At that time, however, the problem appeared to the officers to have been resolved."

A short time later, police were summoned by Butler, who called to report the shooting. Police say alcohol was involved.
