An arrest warrant for probation violation has been issued for a man acquitted in the traffic death of a highway patrol trooper and later convicted in another drunken-driving case and deported.

The warrant was issued in case Alberto Rodriguez Bueno, 27, ever returns from Mexico.Bueno, who was deported two months ago, is wanted for allegedly failing to comply with his probation for an unrelated drunken driving arrest in May.

Last December, Bueno was charged in the hit-and-run death of trooper Joseph Brumett as the officer was directing traffic on I-15 in Salt Lake County.

A jury found Bueno innocent of negligent homicide, but convicted him of driving without a license or insurance and for leaving the scene of the accident.

Five months later, he was arrested in Price for drunken driving. He received a 90-day suspended jail sentence, three years' probation and was ordered to pay $9,500 in restitution.

Bueno failed to report to his probation officer after his release from the Carbon County Jail, said corrections spokesman Jack Ford. Authorities picked up Bueno three months ago in Price.

Immigration and Naturalization Service agents deported him Oct. 6.

Defense attorney Solomon Chacon said the last contact he had with his client was shortly before Bueno was transported to Denver for deportation.

"I am surprised they have not terminated his case and left it at that," Chacon said. "He is out of the country and will never have the ability to pay."
