WEST POINT — Dee Dee Derian could face criminal charges for wearing a bikini while working in her yard.

Some of her neighbors consider it indecent, and at least one called police.

Derian, the owner of a topless maid service, says she is being singled out by vindictive neighbors who do not like what she does for a living. She insists her swimsuit covers everything it should.

Davis County sheriff's Lt. Dan Horton said neighbors have complained three times, the most recent on Friday.

"Her neighbors are pretty persistent about this," Horton said. "We've got to respond when we have a complaint."

The information has been forwarded to County Attorney Mel Wilson, who said Monday he had not yet seen it.

Horton said deputies read Derian — a one-time candidate for West Point City Council — Utah's lewdness statute on one of the calls to her home.

The law lists a number of acts that are not allowed and also prohibits "any other act in a public place or under circumstances (that) will likely cause affront or alarm" to another.

Derian denies violating the law, saying she was wearing a "standard-size" bikini.

She said she cannot understand why she might be charged with a crime for wearing a bikini in her yard when the Utah Jazz Dancers and the Utah Bikini Team are not prosecuted for their attire.

Derian said a neighbor continually drove by her house on Friday, snapped pictures of her while she worked in her yard and yelled sexual remarks at her.

When the police were called, she says, she unsuccessfully tried to file a complaint of harassment or stalking. Police also declined to tell her who had made the complaint. They did not release the report Monday.

Derian says she just wants to be left alone to run her business and wear a bikini in her front yard if she so chooses.

"The deputies should have a little more to do than worry about what I'm wearing in my own yard," she said. "It's not like I'm visually offensive or something; people tell me I look quite a bit younger than 40."
