Judge denies Utah State football

players' request for separate hearings

LOGAN - First Circuit Judge Burt Harris on Tuesday denied a request for separate preliminary hearings for two Utah State University football players and another student charged with assaulting two women.

Harris said it was "in the interest of judicial economy" to combine the cases and he set a one-day preliminary hearing for June 2.

Football players Efram Haymore, 21, and Wendell Shawn Johnson, 22, along with Jonathan E. James, 19, are charged with two counts each of aggravated assault in connection with the incident at a Logan apartment April 25. Each charge is a third-degree felony.

Johnson and Haymore also are charged with one count each of interfering with a police officer during an arrest. That crime is a Class B misdemeanor.

Deputy Cache County Attorney Pat Nolan had filed a motion to combine the hearings, saying the state shouldn't have to pay for "parading the same evidence by a minimum of 18 witnesses."

Attorneys for all three had asked the judge for separate hearings.
